Terofit — Terms of Service

1. Eligibility

• You must be at least 18 years old to use Terofit.
• By using the App, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.
• If we learn that a user is under 18, we will terminate their account and delete their data.

2. Account Registration

• You must create an account to use Terofit. You may register using your email address or a supported third-party sign-in provider (e.g., Google).
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information during registration and to update it as necessary.
• You must notify us immediately if you suspect unauthorized access to your account.

3. Description of the Service

Terofit is a personal nutrition, fitness, and wellness tracking application. The App provides:

• Calorie and macronutrient tracking — Log meals manually or using AI-powered photo recognition.
• Personalized nutrition targets — Calorie and macro goals calculated from your body profile and fitness goals using established metabolic equations (Mifflin-St Jeor).
• Adaptive TDEE recalibration — Your calorie targets adjust over time based on your actual weight and intake history.
• Health data integration — Sync activity and sleep data from Apple HealthKit (iOS) or Health Connect (Android).
• Hydration tracking — Track daily fluid intake across beverage types.
• Sleep analysis — View sleep duration, stages, and efficiency trends.
• Menstrual cycle adjustments (optional) — Adjust nutrition and activity recommendations based on cycle phase.
• AI coaching insights — Receive behavioral analysis and personalized recommendations.
• Photo-based meal logging — Identify food items and estimate calories from photographs using AI.

4. Medical Disclaimer

TEROFIT IS NOT A MEDICAL DEVICE, MEDICAL SERVICE, OR SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE.

• The App provides general wellness and fitness information only.
• Calorie calculations, macro targets, weight projections, sleep analysis, and coaching insights are estimates and are not medical diagnoses or prescriptions.
• The AI-powered food identification and calorie estimation features are approximations and may contain inaccuracies.
• Menstrual cycle phase adjustments are based on generalized models and may not reflect your individual physiology.
• Always consult a qualified healthcare professional before making significant changes to your diet, exercise routine, or health regimen — especially if you have a medical condition, eating disorder, or are pregnant or nursing.
• Do not disregard or delay seeking professional medical advice because of information provided by the App.
• If you experience a medical emergency, contact emergency services immediately. Do not rely on the App.

5. Health Data

5.1 Apple HealthKit & Health Connect

• Terofit integrates with Apple HealthKit and Google Health Connect to read activity and sleep data with your explicit permission.
• Health data accessed through these platforms is used exclusively to provide the App's health and fitness features.
• We do not use HealthKit or Health Connect data for advertising, marketing, or sale to third parties.
• You may revoke health data access at any time through your device settings.

5.2 Sensitive Health Information

• Body metrics (weight, height, sex, age), nutrition data, sleep data, activity data, and menstrual cycle data are considered sensitive health information.
• This data is processed and stored in accordance with our Privacy Policy.

6. User Conduct

You agree not to:

• Use the App for any unlawful purpose.
• Provide false or misleading information in your profile.
• Attempt to gain unauthorized access to other users' accounts or our systems.
• Reverse-engineer, decompile, or disassemble the App or its backend services.
• Use automated scripts, bots, or scraping tools to access the App.
• Interfere with or disrupt the App's infrastructure or services.
• Use the App to develop a competing product or service.
• Share your account credentials with others or allow others to use your account.
• Upload content that is illegal, harmful, abusive, or violates the rights of others.
• Circumvent or attempt to circumvent any security features of the App.

7. Photo & Image Use

• When you use photo-based meal logging, your food photographs are transmitted to our AI analysis services for processing.
• By submitting photos, you grant Terofit a non-exclusive, worldwide license to process, analyze, store, and use the images for the purpose of providing and improving the App's food identification and nutrition estimation features.
• Do not submit photos containing sensitive personal information, identifiable individuals, or inappropriate content.
• We may retain processed images and AI analysis results for quality assurance purposes as described in our Privacy Policy.

8. Intellectual Property

• The App, including its design, code, algorithms (including the Brain Engine, Pigeon Engine, and Misale Engine), content, and branding, is the property of Terofit Corp and is protected by intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
• You may not copy, modify, distribute, sell, or create derivative works based on the App or its content without our prior written consent.
• "Terofit" and associated logos are trademarks of Terofit Corp. Unauthorized use is prohibited.

9. Third-Party Services

The App relies on third-party services to function:

• Firebase (Google Cloud) — Authentication, data storage, and cloud functions. Subject to Google Cloud Terms of Service.
• AI Nutrition Analysis — Third-party AI service for food photo identification and calorie estimation.
• Apple HealthKit / Google Health Connect — Health data syncing, subject to Apple's and Google's respective terms.

We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is governed by their respective terms and policies.

10. Accuracy & Limitations

• Calorie and nutrition estimates (whether from manual entry, AI photo analysis, or database lookup) are approximations and may vary from actual values.
• AI food identification may misidentify foods, portions, or ingredients. Always review and correct AI-generated entries.
• Weight projections and TDEE calculations are mathematical models and may not accurately predict your individual results.
• Sleep and activity data depends on the accuracy of your device's sensors and health platform.
• Coaching insights are algorithmically generated and should not be treated as professional advice.
• We make reasonable efforts to ensure accuracy but do not guarantee that any data, calculation, or recommendation provided by the App is error-free.

11. Account Termination

11.1 By You

• You may delete your account at any time through the App's settings.
• Account deletion permanently removes your profile, health data, nutrition logs, reports, coaching insights, and authentication credentials from our primary database.
• Residual copies in logging infrastructure will be purged within 90 days of deletion.

11.2 By Us

We may suspend or terminate your account at any time if:

• You violate these Terms.
• You engage in fraudulent or abusive behavior.
• We are required to do so by law.
• We discontinue the App or any of its features.

We will make reasonable efforts to notify you before termination, except where prohibited by law or where immediate action is necessary.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, Terofit disclaims all warranties, including but not limited to:

• Merchantability — We do not warrant that the App will meet your requirements.
• Fitness for a Particular Purpose — We do not warrant that the App is suitable for medical, clinical, or diagnostic purposes.
• Accuracy — We do not warrant that calorie estimates, nutrition data, weight projections, AI identifications, or coaching insights are accurate or complete.
• Availability — We do not warrant uninterrupted or error-free operation of the App.
• Security — While we implement reasonable security measures, we do not warrant that the App is immune to unauthorized access or data breaches.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

• Terofit Corp, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health complications, personal injury, or loss of profits, arising from or related to your use of the App.
• Our total aggregate liability for any claim arising from or related to the App shall not exceed the amount you paid to Terofit in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.
• This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).

Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by our negligence.
• Fraud or fraudulent misrepresentation.
• Any liability that cannot be excluded or limited under applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Terofit Corp and its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any third-party rights.
• Any content (including photos) you submit through the App.

15. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
• Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive relief in a court of competent jurisdiction.
• Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in a class action, class arbitration, or representative proceeding.
• For users in the European Union, this section does not override any mandatory consumer protection rights under EU law, including the right to bring proceedings in your local courts.

16. Changes to These Terms

• We may modify these Terms at any time by posting the updated version in the App.
• Material changes will be communicated through in-app notification or email.
• The "Last Updated" date at the top will reflect the most recent revision.
• Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the App and delete your account.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Terofit Corp regarding your use of the App and supersede all prior agreements and understandings.
